The Suo Moto notice taken by the Hon’ble Federal Shariat Court of Pakistan regarding forced marriage of a 5 years old girl in Baluchistan was fixed for hearing today. Brief facts of the matter are that one Muhammad father of the girl lodged an FIR in police station Khuzdaar regarding forced marriage of his 5 years old daughter due to local and tribal culture prevailing in area in consideration of another marriage of his son with daughter of accused. On media reports and registration of FIR, the Hon’ble Chief Justice Dr. Syed Muhammad Anwer took Suo Moto notice as this act seems to be an un-islamic one as well as against the Constitution of Islamic Republic of Pakistan, 1973. The cruel, un-Islamic and heartless ritual is found in many parts of Pakistan where girls, are given in marriage or servitude to an aggrieved family as compensation to end disputes, often murder. Under this custom the personal liberty of a woman is restricted for the rest of her life against all norms of justice therefore contravening to the Islamic Injunctions and also to Article 9 of the Constitution. The matter was fixed for hearing today before the Full Bench of FSC comprising Chief Justice Dr. Syed Muhammad Anwer and Justice Khadim Hussain M. Sheikh. During the course of hearing, the Hon’ble Court took serious notice of the incident and directed the respondents to submit complete report regarding the matter. The Hon’ble Court particularly directed the Law Officer, appearing on behalf of province of Baluchistan to submit complete report of the occurrence. The Court further directed to submit report regarding legislative development regarding forced marriage and steps taken by the Government of Baluchistan and other provinces. The matter was adjourned to a date in office on the request of respondents.
