The Full Bench of the Hon’ble Court comprising of Hon. Mr. Justice Muhammad Noor Meskanzai Chief Justice, Hon. Mr. Justice Dr. Syed Muhammad Anwar and Hon. Mr. Justice Khadim Hussain M. Shaikh, in exercise of power under Article 203-DD of the Constitution of Islamic Republic of Pakistan announced its judgment in Criminal Appeal and criminal Revision filed by Mujeeb ur Rehman and others versus the State against the judgment passed by the learned Additional Sessions Judge/IZQ, District Dir Lower at Chakdara. The trail Court convicted all the appellants and awarded death penalty to Mujeeb-ur-Rehman and Haqdar Ali, and sentenced appellants Noor-ul-Haq, Yousaf Khan and Anwar Ali to suffer life imprisonment while trial Court also made reference for confirmation of the death penalty of two appellants. One complainant named Alamgir filed Criminal Revision Application for enhancement of the sentence by converting the sentence of life imprisonment awarded to appellants Noor-ul-Haq, Yousaf Khan and Anwar Ali into death sentence. Full Bench of Federal Shariat Court after thorough examination of record and hearing all the parties and their Counsels announced its judgment and dismissed Criminal Appeal and Criminal Revision Application for being devoid of merit having no substance in it. The Criminal Murder Reference seeking confirmation of death sentence of two appellants namely Mujeeb-ur-Rehman and Haqdar Ali is answered in affirmative.
