The Full Bench of this Hon’ble Court comprising of Hon. Mr. Justice Muhammad Noor Meskanzai Chief Justice, Hon. Mr. Justice Dr. Syed Muhammad Anwar and Hon. Mr. Justice Khadim Hussain M. Shaikh, in exercise of power under Article 203-D of the Constitution of Islamic Republic of Pakistan, announced its judgment in various Shariat Petitions titled as Mst Skina Begum and others versus Govt. of Pakistan and others. In these petitions Martial Law Order No. 425 dated 12.4.1984 was challenged to be declared as repugnant to the injunctions of Islam. The Court, after hearing the parties in detail and perusing of the record in the remanded judgment dated 3.12.2020, accepted these petitions and declared that the impugned Martial Law Order is repugnant to the Injunctions of Islam as laid down in the Holy Quran and Sunnah of the Holy Prophet (??? ???? ???? ????).
