A full bench of the Hon’ble Federal Shariat Court comprising of Hon’ble Mr. Justice Muhammad Noor Meskanzai Chief Justice, Hon’ble Mr. Justice Dr. Syed Muhammad Anwer and Hon’ble Mr. Justice Khadim Hussain M. Shaikh passed an important judgment, maintaining death sentence on three counts awarded by the learned Additional Sessions Judge-I, Karachi East, under Sections 364-A, 376 and 302(b) of the Pakistan Penal Code, 1860 to the convict Muhammad Irshad who had committed barbaric, heinous and inhuman act of zina-bil-jabr and murder of the baby girl Tajjali aged about 6 years of Karachi. The innocent girl was playing with other kids and was sinisterly lured into believing that the culprit would bring toy for her instead she was raped and thereafter murdered.
The Hon’ble Court in another Judgment also upheld death sentence awarded by the learned Additional Sessions Judge/MCTC, Pishin to the convicts Ali Muhammad and Najeebullah under Sections 302(b)/34 PPC.
The Division Bench comprising of Hon’ble Chief Justice and Hon’ble Mr. Justice Khadim Hussain M. Shaikh dismissed the appeal filed by Shehbaz Ali against the judgment passed by the Additional Sessions Judge-I/MCTC, Lasbela at Hub. The Court maintained his conviction recorded under sections 394, 302(b), 324 & 337(d)-PPC, whereas, appeal filed by Rizwan Sattar is partly accepted. Conviction recorded under section 394 PPC is upheld and maintained while conviction recorded under sections 302(b), 324, 337(d) PPC is set aside to the extent of Rizwan Sattar.
