PR No.114 HCJP DISPOSES OF HUMAN RIGHTS CASE AND ENSURES THAT TRANSGENDERS ARE TREATED EQUALLY Islamabad

The Hon’ble Chief Justice of Pakistan Mr. Justice Mian Saqib Nisar has taken notice of the complaint that transgenders were being pressurized by police to leave Mardan.

An NGO “Vision Pakistan” submitted an application on behalf of transgender alleging that Mardan police was raiding at the houses of transgender and harassing them to leave Mardan district. They are also allegedly pressing the landlords who have rented their premises to transgenders for abode to get their places vacated and Police had got their houses locked with their personal belongings forcing them to find some other place to reside outside District Mardan, where after they may come to collect their belongings. Reportedly police was acting under the pressure of elements who are not prepared to treat transgender as human beings and were pressurizing to force them out from Mardan.

The Hon’ble Chief Justice of Pakistan directed District & Sessions Judge, Mardan to take up the matter and to apprise Supreme Court about the position on the same day i.e. 9th February, 2017.

Complainant transgender Alisha and Sidra appeared before District Judge in person along with representative of the NGO. SP Operation Mardan was also summoned who also put his appearance before the court.

Statement was given by police that transgender will not be harassed or pressurized in any manner and full protection will be provided to them. That any notice given by the local police to their landlords will be withdrawn by the police and they will be asked not to eject them without due course of law.

In view of such assurance given by the local police and on satisfaction of complainant transgenders Alishah and Sidra, the matter was disposed of, clarifying that  in  case of any violation in future by police or the landlords they can again bring the matter in the notice of  the court.
