PR No. 32
INDIA'S IMPUNITY MUST STOP, UN MUST INTERVENE
Islamabad: January 06, 2021

1. We demand strongly that India's impunity on Kashmir's freedom and human rights activists must be stopped immediately.
2. India is reigning its occupation troops on the Illegally Occupied Jammu and Kashmir ( IIOJ&K) region with no regards to the rights of the Kashmiris for a dignified and independent existence .
3. With the current grave situation that is facing the Kashmiris in the sieged region of the IIOJ&K , the brutality of a barbaric scale by more than 900,000 Indian troops against Kashmiris are a clear violation of all international laws. It is more than just an occupation but extermination.
4. We call the UN to intervene without delay. UN has the obligation to stop this inhumanity and gross violation of international laws by India on Kashmiris.
5. The worsening human rights violation and forced demographic change to alter Kashmir from a Muslim majority populated territory to a Hindu dominated region is a dangerous path. A regional instability will be an imminent outcome if this is not checked .
6. The human rights violation are visible and well recorded. The brutality and injustice is glaring enough for the UN to step in. India's atrocities if not halted will be a legitimate retaliation from the oppressed.
7. The Indian troops have acted beyond the rules of the standard international law to claim that India was to weed out so called terrorists. Under the pretext of the so called crackdown operation to take down terrorists, India is executing extra judicial murders, torture in custody and detention without access to legal recourse.
8. We register our protest against the Indian authorities that has launced an operation to crush voices of dissent, curtail rights to demand for freedom and human rights of the Kashmiris.
9. The extrajudicial killings and collective punishment by barbaric raids on homes and setting ablaze houses by Indian troops cannot be allowed to persist and those responsible go unpunished.
10. India must be held fully responsible to the atrocities and crimes against humanity in the IiOJ&K . Its appetite to lunch a full genocide operation in the disputed territory is emboldened by the support it received from israel and the US.
11. Despite the gross inhumanity suffered by the Kashmiris , we do not comprehend the lackadaisical attitude of the UN. While communications and resolutions were declared in recent years with full documented reports of the situation in the IIOJ&K, no change seems to be anywhere close to peace and justice.
12. What more do the UN want to learn before the genocide of the whole population of Kashmir will be executed by the Hindutva agenda of the BJP-RSS regime ? The pervasive incidents of attacks on Kashmir civilians on a daily basis is well documented . UN should respond with a greater weight to stop India's aggression.
Effective diplomatic pressure and the courage to take firm action against India must be launched.
13. We take cognizant of the two Kashmir reports of 2018 and 2019 and the concerns communicated by the office of the High Commissioner for Human Rights on the issues of violations , arbitrary arrests , forced dissapearances, restriction of movements, and violent crackdowns.
14. The Indian judiciary is clearly complicit in legitimizing unlawful actions by the Indian goverment and we do not have much confidence of a free and fair trial for the Kashmir political activists under detention.
15. We perceived that the incarceration of Kashmir leaders by applying draconian laws of India is to suppress the people's resistance and uprising to defend their rights for justice and self determination.
16. The mass murder and deliberate injuring of Kashmir civilians including infants, childrens, women and the old , have never ceased since India's occupation. Under the silence , non concrete action and incapacitated international community of the UN, India has taken upon itself the unlimited authority to inflict maximum pressure against Kashmiris civilians with impunity.
17. We take serious concern on the inhuman treatment of freedom activists in custody who have been tortured and barred from a proper access to legal defense.
18. The reported case of Ms Aasiya Andrabi and her associates is glaring. Since her incarceration with several other activists , she is now under tremendous brutal ordeal in a concocted range of criminal allegations. The politically motivated charges have not undergone legal scrutiny leaving her at the behest and mercy of the Indian authorities.
19. She has been subjected to physical and mental abuses and tortures.
We condemn the unimpeded violation of the legal rights of the detainees of conscience of Kashmiris under the BJP-RSS regime.
20. We take note seriously the impending sentencing of Ms Aasiya Andrabi, leader of the largest Kashmir women's human rights organization , Dukhtaran-e-Millat , who has been fasely charged without due course of the law. Since her detention in 1992 and incarcerated for 15 years, the Indian court has denied her for a proper legal counselor.
Her detention now in Tihar jail in New Delhi is waiting for a conviction on the 18th January 2021. Dubious charges under the draconian laws of India on Ms Andrabi, her husband and her associates are an affront to international standards of criminal proceedings. The posibility of her been sentenced to death by the Indian court is a imminent. The international community must not remain silence on the fate of the victims of the Indian ruthless oppression. Apprehending political dissent amongst Kashmir activists like Ms Andrabi and her associates reflects the brute force of the Indian occupiers. The judiciary system of India is in question. Cases of trials of political dissenters , is now under the influence and direction of the BJP-RSS regime.
21. We demand that the orchestration of judicial proceedings to crush political dissenters amongst Kashmir leaders must be put to a stop.
22. We take strong objection to India's impunity to suppress dissenting voices while the international community keeps a deafening silence especially to direct real concrete actions.
23. We call the UN to prevail upon India that it must halt its policy of oppression and occupation on Jammu Kashmir.
24. India has no right to abrogate Kashmir's autonomous status and it must refer to the UNSC resolution for a plebiscite to be conducted for the people of Kashmir to decide their own future.
We call and demand that :

1. UN to intervene in the case of Ms Aasiya Andrabi and her associates to ensure protection of their human rights and torture in custody.
2. The concocted charges against Ms Andrabi must be dropped and she should be released unconditionally.
3. India must end all persecutions on Kashmir political dissenters and human rights activitists and those apprehended without charge must be released.
4. Indian security officials must be investigated to identify those responsible for the violant attacks on Kashmir civilians.
5. Draconian laws intended to crush Kashmir political activists and human rights defenders must be revoked.
6.UN must intervene to investigate Kashmiris human rights activists reported being tortured , physically and mentally abused under detention in Indian jails.
