NATIONAL ASSEMBLY STANDING COMMITTEE APPROVES CIVIL PROCEDURE AMENDMENT BILL

The standing Committee of National Assembly has approved Civil Procedure Amendment Bill with overwhelming majority of the members voting for the bill. The objective of the Bill is to enable the courts to deal with the cases justly and fairly and save expense and time of both courts and litigants. The Bill provides for two tier system in civil suits. All suits, in which interlocutory applications have been filed, will have duplicate sets for hearings in two separate courts. A stay order will have no impact on the main case. This will diminish chance of delay in the main case due to stay order. According to the Bill the witnesses will have to record their statements in the civil litigation. Rules and regulations will be made for the use of electronic devices. The courts will monitor the recording of statements with the help of electronic devices. Furthermore judges in such cases may carry out spot checks to ensure that the court orders have been implemented. The courts may call for evidence of any person or documents at the spot. The passage of the Bill into law will help counter possibility of human error that has tainted the civil litigation procedure for years.
